This contract sets out the terms and conditions for the rental of the Maxus 21 sailing boat (hereinafter “the Boat”) moored at Harbour de Cheyres on Lake Neuchâtel, Switzerland, between the Lessor (Grégory Undritz) and the Lessee.
The boat is rented with a full safety kit in accordance with Swiss legislation (LNI), an outboard motor, and a set of sails (mainsail and jib).
A security deposit of CHF 1,000 is required prior to embarkation. As the boat does not have comprehensive insurance, this deposit is intended primarily to cover:
If the cost of repairs or replacement exceeds the amount of the deposit, the balance remains entirely the responsibility of the hirer (see Article 6). The deposit will be refunded following a satisfactory return inspection.
Cancellation by the hirer: In the event of cancellation less than 30 days before departure, 50% of the rental cost is due.
Weather conditions: In the event of dangerous weather (storm warning confirmed by the lessor), the rental may be postponed. No refund will be granted for light rain or lack of wind.
Lessor’s Insurance: The Boat is covered solely by Third-Party Liability Insurance (TPL). This insurance covers bodily injury and property damage caused to third parties by the Boat.
No Hull Insurance (Damage to the Boat): The Boat does not have hull insurance (neither partial nor collision cover). Consequently, all material damage, damage, loss or deterioration occurring to the Boat itself or its equipment during the rental period is the sole responsibility of the Renter.
Coverage of damages by the Renter: In the event of an accident or damage to the Boat, the costs will first be deducted from the deposit of CHF 1,000. If the costs exceed this amount, the Renter undertakes to cover the full amount of the difference. It is the Tenant’s responsibility to ensure that their own Personal Liability Insurance (PLI) or specific skipper’s insurance expressly covers damage caused to hired boats.
Accidents and personal effects: Accident insurance for occupants and cover for the crew’s personal effects are not included in the rental and are the responsibility of each crew member’s personal insurance.
An inventory and inspection (check-in/check-out) will be carried out on departure and return. The hirer undertakes to return the boat in the same clean and operational condition as on collection.
